State lawmakers have sent Governor Healey an economic development bill containing a provision that would exempt entities using “shared appreciation mortgages” from lawsuits and state consumer protection laws. The provision stands to benefit BlueHub Capital, a Roxbury-based nonprofit under fire for alleged predatory practices.

Under its BlueHub SUN program, BlueHub buys foreclosed homes, resells them to the original owners, and imposes shared appreciation mortgages that entitle the nonprofit to a significant portion of any increased home value when the homeowner sells or refinances. However, this model exploits vulnerable homeowners.

NACA, the nation’s leading advocate for economic justice and affordable homeownership, is calling on Governor Maura Healey to veto a concerning legislative amendment that could shield BlueHub Capital—a nonprofit accused of predatory lending—from accountability under state consumer protection laws.

Why This Matters?

By exempting BlueHub from liability, the amendment undermines consumer protection and sets a dangerous precedent. Families who fought to reclaim their homes could face financial losses due to BlueHub’s practices, while other entities may follow suit, bypassing critical regulations that protect vulnerable communities.

Bruce Marks, NACA’s CEO, strongly opposes this amendment, “This is the epitome of corruption. If this stands, it sends a clear message that money and influence can buy immunity from regulation, putting homeowners at risk and eroding trust in our legal system.”
